Staffing Company Watchlist

Below is a list created by the Fair Work Alliance to highlight staffing companies that have been reported to engage in employee misclassification which results in the violation of labor laws, exploiting workers, or failing to provide fair wages, safe working conditions, or basic benefits.

Instawork

Instawork is on our watchlist for misclassification of employees as independent contractors. They employ both 1099 Contractors and W2 employees. They allow their clients to choose how to classify these employees. Below are a few examples of Instawork issues in regards to labor violations:

• Been found to have committed over 20,000 labor violations by the City of Denver,
• Had a lawsuit filed by a competitor in California alleging misclassification
• Sued by employees for stealing their tips
• Been sued in a class action lawsuit in the state of California for misclassification
• Had an employee with a pre-existing criminal record shoot and kill one coworker and wound another, calling into question their background check practices.

Qwick

Qwick is on our watchlist for misclassification of employees as independent contractors. They employ both 1099 Contractors and W2 employees. They allow their clients to choose how to classify these employees. Below are a few examples of actions taken against Qwick in regards to labor violations:

• Been found to have misclassified workers by the city of San Francisco
• Had a lawsuit filed by a competitor in California alleging misclassification
• Been sued in a class action lawsuit in the state of California for misclassification

Wonolo

WONOLO is on our watchlist for misclassification of employees as independent contractors. They employ both 1099 Contractors and W2 employees. They allow their clients to choose how to classify these employees in states outside of California.

Below are a few examples of actions taken against WONOLO in regards to labor violations:

• Forced to reclassify workers as employees in the state of California
• Found by the Ohio Bureaus of Workers Compensation to be misclassifying workers

Gigpro

GIGPRO is on our watchlist for misclassification of employees as independent contractors. They employ 1099 contractors.
• Been found to have misclassified employees by the city of Denver, Colorado
